Terms and Conditions

A standard day is 8 hours (less 1 hour for breaks) = 7 hours training time (3.5 hours = ½ day).

An Open Learning course enrolment is accepted only when programme fees have been fully paid. Until participants have enroled, they are considered an applicant and are ineligible for refunds or credits.

An In-Company Learning booking shall mean an in-house, customised or tailored programme, dates are confirmed and signed and/or verbal agreement, purchase order or a deposit fee paid - until this task is complete, no dates are confirmed.

Programme in Terms and Conditions shall mean In-Company and/or Open Learning Programmes, nationally accredited or non-accredited training and education, or coaching and consulting service.

Legally Enforceable Agreement - This ‘Terms and Conditions’ serves to document a legally enforceable ‘Agreement’ [initiated in the ‘Proposal’ or as a ‘Verbal’] for 3CM Pty Limited (3CM) to deliver the full or any part of its products and services to individuals, commercial and corporate enterprises.

Deed of Indemnity from 3CM’s parent company – This provides the financial resources available to meet the 3CM’s obligations to students and clients in the event of a default.

Standards of behaviour – In general terms, participants on 3CM programmes are required to follow the same standards of behaviour that apply in the industry sector that the programme relates. As part of the orientation session for each program, the 3CM facilitator will outline the specific ground rules that apply in that program. If the behaviour of any student does not comply with the standards outlined, the programme facilitator will speak with the student. If the case arises where a studentt continues to disregard the standards of behaviour that have been outlined for a particular programme, 3CM reserves the right to exclude the student from the remainder of the programme, with no refund of fees paid.

3CM reserves the right to refuse enrolment or registration of any applicant.

Code of Practice - 3CM Assessors follow the Code of Practice for Assessors, as outlined in the Training Package for Training and Assessment. For a copy of this Code of Practice, please contact 3CM.

Access and Equity - In all approaches to training and assessment 3CM is committed to access and equity. If there is a particular need that may be a barrier to successfully completing the training or assessment, the participant is free to discuss this with 3CM prior to enrollment. Wherever possible, 3CM will make what is called ‘reasonable adjustment’ to meet the needs of an individual or group clients.

Language, literacy and numeracy – 3CM staff make a special effort to ensure that the language used in our programs is meaningful to people working in the industry that each program is related to. However, 3CM has specialist language literacy and numeracy expertise. However, if there is a particular need for a program to develop language literacy and numeracy skills, 3CM will be happy to refer you to a training organisation that has special skills and programs that meet these needs.

Accessing records – Participants are entitled to have access to the personal information that 3CM holds about themselves. If they would like to arrange access to their records and a copy of our privacy policy, please contact us.

Certification – 3CM reserves the right to withhold any, all Statement of Attainments or Certificates of nationally recognized or non-recognised training until payments of professional fees paid in full.
Recognition of Prior Learning (RPL) and Qualifications

3CM recognises accredited qualifications and statements of attainment issued by other Registered Training Organisations. A ‘RPL Information Guide’ is available from 3CM fees apply.

Skills Recognition services (RPL/RCC) hours/days quoted in Service Fees include Facilitator assessment time but do not include any additional Workplace Assessment Support required by the participant to complete assessments (see Value-Added Services). All fees must be paid up front and are non-refundable.

Skills Recognition (RPL/RCC) hours quoted in Service Fees includes all time provided by Facilitator, including consultation and interview time, assistance with preparing Evidence Portfolios, and assessment time.
Open Learning Programmes

These Terms and Conditions serve as a legally enforceable agreement for 3CM Pty Limited to deliver the Open Learning services.

All Open Learning courses require a minimum of six enrolled candidates to run; however based on financial viability 3CM reserves the right to make the final decision on number of students.

Open Learning course fees are payable in advance. 3CM reserves the right to withdraw any student from a course if payment has not been received in accordance with 3CM’s payment terms.

Payment Details – Tax invoice issued on registration, payment in full by cheque or credit card no later than five (5) business days before course commencement.

Credit Card - A surcharge of 2.5% will apply for credit card payments.

Overdue payments are subject to a 10% surcharge calculated on the balance and applied monthly until the account is finalised. All incurred legal and other associated costs will be the recoverable in addition to the surcharge from the debtor.

Courses that denote non-accredited are subject to GST.

Group Discount – when an organisation registers THREE (3) or more on any 3CM Open Learning course, they will be entitled to a 5% discount. All enrolments must be submitted at one time.

3CM reserves the right to reschedule any Open Learning course. In this event students will be placed on the next course or receive a full refund or credit (up to 6 month from issue).

3CM will process refunds within 28 days of approval. 3CM will deduct by any amount owing by a student or organisation for professional services delivered.

Cancellations and Transfers MUST be in writing by letter, facsimile, and email to 3CM Management.

Cancellations and Refund Policy –
- Cancellations received in writing at least ten (10) business days prior to course commencement, will be subject to a 25% administration fee of the total Tax Invoice.
- Those received within ten (10) business days of course commencement will be subject to a 50% administration fee of the total Tax Invoice.
- The course fee is non-refundable five (5) business days before the course commencement.
- All applications for refund will be assessed fairly and reasonably. Refund assessments will be subject to costs incurred and loss of revenue.

Please note that if you do not cancel, you are still responsible for payment.

Transfers Policy –
- Transfers received in writing to another course or future course date (up to 60 days from original course date) up to ten (10) business days prior to course commencement will be subject to a 10% administration fee of total Tax Invoice.
- Transfers within ten (10) business days of course commencement will be subject to a 25% administration fee of total Tax Invoice.
- Maximum TWO (2) transfers allowed per enrolled course.

Substitutions Policy – substitute candidates are acceptable at any time and no charge.

Late registrations will be subject to availability.

Integrated Assessment of Portfolios and Projects – Nationally Recognised Qualification courses and/or programs are fully assessed programmes. After completing the clustered or individual modules, candidates are given a ‘Candidates Assessment Kit’ a flexible project that guides them through the Summative assessment process. On completion, a 3CM Assessor will review and assess the evidence against the competencies for the level of qualification.

Students can elect to have an On-Site Assessment. Fees are on 3CM’s Summary of Charges and Fees, and apply within twenty (20) kilometers from CBD; a Travel Recovery Fee will apply as per the Australian taxation Office commercial travelers guide.

In-Company Learning Programmes

These Terms and Conditions serve as a legally enforceable agreement for 3CM Pty Limited to deliver the In-Company services.

In-Company Programmes can be customised or tailored for organisations, fees apply for design and development

A In-Company service includes customised or tailored in-house courses and programmes, surveys, consulting, coaching, specialised training and assessments, audits, team facilitation, etc.

While In-Company Learning Programmes recommend a minimum of six (6) participants for cost effectiveness, group size may be as few as one (1) participant - full fees as stated still apply. 3CM reserves the right to extend the group maximum size.

Legally Enforceable - This Terms and Conditions serve as a legally enforceable agreement for 3CM Pty Limited to deliver Services as defined within the 3CM ‘Proposal’ whether it is written, verbal or in electronic format.

Substitutions Policy –
- Students in In-Company Programmes may be substituted at any time prior to programme or course commencement (under the same conditions). Additional time/resources used by 3CM, due to the substitution, an additional service fee of $295 and any logistical and consumable costs will apply.

Cancellations and Refund Policy–
- Cancellations received in writing at least ten (10) business days prior to course commencement will be subject to 25% administration fee of the total Tax Invoice.
- Those received within ten (10) business days of course commencement will be subject to a 50% administration fee of the total Tax Invoice.
- Those received within five (5) business days before the course commencement will be subject to and liable for the full payment of the Tax Invoice. This includes pro rata revenue lost via the governments Productivity Placement Programme funding.
- All applications for refund or credit will be assessed by 3CM fairly and reasonably.

- Transfer received in writing of a In-Company Programme or Course to a future date (strictly, up to 60 days from course date) may be made up to ten (10) business days prior to original commencement date will be subject to a 25% administration fee.
- Transfers within ten (10) business days of original commencement will be subject to a 50% administration fee.
- Maximum TWO (2) transfers allowed per Premium Program/Course.
- Transfers MUST be in writing by letter, fax, or email to 3CM Management.

Cancellations, Transfers and Substitutions MUST be in writing by letter, facsimile, and email to 3CM Management. Please note that if you do not communicate in writing, you are still responsible for payment.

3CM will process refunds within 28 days of approval. 3CM will deduct by any amount owing by a client.

Payment Details – Tax Invoices issued weekly and payment will be strictly within seven (7) days of invoice date.

Credit Cards - A surcharge of 2.5% will apply for payment by credit card.

In-Company Courses and Programmes that denote non-accredited are subject to GST.

Quoted fees and considerations in the 3CM proposal or any form of communiqué are valid for fourteen (14) days only from date of proposal. Reconfirmation of fees and considerations will be in writing from 3CM.

Public holidays and weekends – when 3CM services scheduled during public holidays and weekends will be subject to an additional 50% surcharge on the agreed schedule of fees.

Delayed travel due to flight cancellations or postponement – when 3CM consultants and/or staff members have experienced travel delay by more than two (2) hours will be subject to an additional 50% surcharge of the agreed schedule of daily fees.

3CM shall not discount or reimburse an organisation for venue costs where the organisation elects to have the Premium Program conducted in off-site premises.

Where In-Company Programmes are conducted outside the metropolitan area all travel, motor vehicle hire, accommodation, and other associated expenses are not covered by 3CM. Reimbursement of these expenses will be at cost plus 15%.

Where travel is required for In-Company Programmes and/or Courses, a travel allowance fee of 50% of the daily professional delivery fee will apply as per 3CM’s Summary of Charges and Fees. The fee will be calculated on per day (based on an eight [8] hour day) or part thereof basis.

Where travel by motor vehicle exceeds 20 kilometers from the CBD, a Motor Vehicle Travel Recovery Fee will apply as per the Australian Taxation Office commercial travelers guide.

Where In-Company programmes and/or Courses are conducted and meals are not provided by the organisation, a Meal Allowance will apply as per the Australian Taxation Office commercial travelers guide.
