Every employee and every manager has a duty of care to provide a safe and healthy working environment. During this programme participants will be presented with details of their responsibilities and with practical examples of how these responsibilities should be enacted in the workplace.
Course Overview
This interactive workshop has been developed to allow staff, volunteers, and carers to enhance their understanding of their Duty of Care and Dignity of Risk within their organisation and in the delivery of service to clients. Participants will have the opportunity to discuss the implementation of Duty of Care in a variety of service models. Activities and group work will allow participants to develop skills and improve their knowledge regarding Dignity of Risk: that risk is an essential aspect of life and it should not be denied.

The content of this program is applicable to all employers and employees, but will have particular relevance for those in a supervisory, team leader or management role.
It applies to individuals with supervisory responsibilities for assisting with legal compliance as part of a systematic approach to managing OHS. It includes identification of common law duty of care, appropriate legislation and regulations and the necessary actions to ensure compliance in the workplace. The unit may apply both in a work unit of a large organisation or in a small to medium enterprise.

- Develop an understanding of their Duty of Care obligations within the workplace and the obligations imposed on others by the law
- Develop an understanding of other Duty of Care considerations whilst providing a service within the human services sector
- Develop an understanding of the delicate balance between the Disability Act and standards and the OHS Act of WA
- Learn how to properly report Duty of Care issues to a supervisor
- Learn how Duty of Care encompasses the rights of a person to self-determined independence and dignity
- Develop an understanding of Dignity of Risk—why it is important, what its limitations are, and how to promote it, and
- Bring about changes in their own workplace to make it safer.
Requirements to Receive the Qualification
By successfully completing the face-to-face workshop and assessment requirements of this unit of competence from the OHS Programme, or apply for Recognition of Prior Learning (RPL). Participants can achieve the nationally recognised qualification with either or combination of both approachs. RPL is a process that enables those who are interested in gaining the qualification to be granted exemption from some or all of the training programmes.
